There is confusion about the definition of heirs.

 

1. Heirs are those who inherit your property both real and personal

2. If you have a will, you name the heirs

3. If you don't have a will, the government names your heirs (in a probate court) but you still have heirs

4. You usually have heirs whether or not you have a will.  

5. If there are no heirs, the state takes title to property by escheat
