In community property states, marital property is jointly owned regardless of title.  Marital property is property acquired during marriage except that:

 

Acquired by gift or inheritance

Purchased with proceeds of separate property

Acquired as income from separate property

 

Marital property is law in some western states and is not recognized in Georgia.
