Characteristics of a Tenancy by the Entireties

 

Tenancy between husband and wife only

Includes right of survivorship

The four unities must be present

Not recognized in Georgia

At the death of one of the tenants, the survivor becomes the owner without the need for a will

Any change in the status of the property (such as sale or mortgage) must have both the husband and wife as parties to the transaction

At divorce, the tenancy is dissolved and automatically becomes a tenancy in common
